In a rather dramatic and unprecedented move, the High Court judge hearing the case of Gambia’s opposition leader Ousainou Darboe and his co accused persons, announced to rescue himself from the matter, the Freedom Newspaper can reveal. The judge, who is said to be a Cameroonian, has referred the case to the Kanifing Magistrate court.
The judge’s decision to excuse himself from the case, followed comments he privately he made on the matter with a US based Gambian journalist Fatou Camara. The judge was prank by the former Jammeh Press Secretary, now living in exile in the State of Georgia, United States.
In a fourteen minute tape conversation, the presiding judge admitted that it was embarrassing for the state to jail a senior member of the Bar Lawyer Ousainou Darboe. He sounded very remorseful during the phone conversation he had with the former GRTS newscaster.
According to the presiding judge, his decision in the case of Darboe and co, would be based on the outcome of the Inter-Party IEC political dialogue. He however said it was against his wish for the leader of the opposition and his followers to be denied bail.
As soon as the case was called this morning in court for hearing, the judge announced that he was rescuing himself from the matter. The defense never objected to the judge’s decision.
Mr. Darboe and co, were subsequently escorted out of court under heavy armed guard. His supporters were outside the premises of court. They cheered up their leader while he was being escorted out of court.
